At Chomper Labs, we believe privacy — like healthy, happy teeth — is a fundamental right. We know that sharing your personal information, let alone a mold of your teeth, takes real trust. We take our responsibility to protect your data seriously, and this page explains exactly how we do it.

The short version

We know a privacy policy isn't why you came here. So before the fine print, here's the honest summary:

  • We only collect what we need to make your night guard — your contact and shipping details, your dental impression, and a few photos of your teeth if you send them for a fit check.
  • Your impression and dental data is yours. We keep it for two years so reorders are easy, then it's destroyed. We will never sell, lease, or trade your dental data. Ever.
  • We don't sell your personal information. Some of the advertising tools we use may count as "sharing" under California law — you can opt out anytime (see below).
  • You're in control. Want your data corrected, deleted, or just want us to stop emailing you? One email to hello@chomperlabs.com and it's done.

The full policy below is the legal version of everything above.


1. Who we are

Chomper Labs LLC ("Chomper Labs," "we," "us") makes custom night guards and related dental products, sold at chomperlabs.com (the "Site"). This policy explains what personal information we collect, how we use it, who we share it with, and the rights you have over it. It applies to the Site and to our related order, account, and customer-support experiences.

2. What we collect

Information you give us. When you place an order, create an account, take our quiz, or contact us, we collect things like your name, email address, shipping and billing address, phone number, and order details. Payments are processed by our payment providers — we never see or store your full card number.

Your dental information. This is what makes us different from most stores, and we treat it with extra care. To make your night guard, we collect your physical dental impression or digital scan, information you share about your teeth grinding and dental history, and photographs of your teeth or impression if you submit them for a fit check or support request. We use this information only to make, adjust, and support your product.

Information collected automatically. Like nearly every website, we and our service providers use cookies and similar technologies to collect device and usage information — things like your IP address, browser type, the pages you visit, and how you interact with the Site. Section 4 explains this in detail.

3. How we use your information

We use your information to:

  • Make, ship, and support your order — including having your impression turned into a finished night guard;
  • Communicate with you about your order, account, and any fit or quality issues;
  • Provide reorders, warranty service, and our fit and satisfaction guarantees;
  • Send marketing emails if you've opted in — you can opt out anytime;
  • Understand how people use the Site so we can improve it;
  • Measure and improve our advertising;
  • Detect fraud, enforce our terms, and comply with the law.

We will only use your dental information for the purposes described in this policy.

4. Cookies and tracking

Cookies are small files stored on your device that help the Site work and help us understand how it's used. We use:

  • Essential cookies — required for the basics: your cart, checkout, and account login. The Site doesn't work without these.
  • Analytics and site-improvement tools — these help us see how visitors use the Site (which pages are visited, where people get stuck) so we can make it better. Some of these tools record anonymized interactions with the Site's pages.
  • Advertising and measurement tools — these help us reach people who may want our products and measure whether our ads work. These are the tools that may involve "sharing" data with advertising partners as defined under some state laws.
  • Email and marketing tools — these help us know whether the emails we send are useful (like whether they're opened) and power features like an abandoned-cart reminder.

Your choices: You can block or delete cookies in your browser settings, though some Site features may stop working. If you're visiting from a region that requires consent for cookies, you'll see a banner letting you accept or decline non-essential cookies. We also honor the Global Privacy Control (GPC) browser signal as an opt-out of sharing where required by law. Our Site does not currently respond to "Do Not Track" browser signals, as there is no common standard for them.

To opt out of the "sharing" of your information for advertising, use the cookie banner (where shown), enable GPC in your browser, or email us at hello@chomperlabs.com with the subject "Do Not Share."

5. Your impressions and dental data

Your impression, scans, teeth photos, and dental history are sensitive, and we hold ourselves to a higher standard with them:

  • Retention: We keep your impression or digital scan for two years from your last order so that reorders and warranty claims are easy. After that — or earlier, if you ask — physical impressions are destroyed and digital files are deleted or anonymized.
  • No selling, ever: We will never sell, lease, or trade your dental or biometric information. This is not qualified by any other section of this policy.
  • Limited access: Only the team members and lab technicians who need your dental information to make or support your product can access it.
  • Deletion on request: Email us anytime to have your dental information destroyed sooner. (Heads up: we won't be able to remake your guard without a new impression.)

A note on HIPAA: Chomper Labs is generally not a "covered entity" under HIPAA, so HIPAA typically does not apply to the information you share with us. We maintain healthcare-grade privacy practices anyway, because it's the right thing to do.

Washington residents: Under Washington's My Health My Data Act, you have the right to access, delete, and withdraw consent for the collection of consumer health data. Contact us at hello@chomperlabs.com to exercise these rights.

6. Who we share information with

We share personal information only with the service providers that make our business run:

  • Payment processors, to securely handle your payment;
  • Shipping and logistics carriers, to get your order to you;
  • Our lab and manufacturing partners, to turn your impression into your night guard;
  • Technology and marketing service providers, such as our e-commerce platform, analytics tools, and email providers, who process data on our behalf;
  • Professional advisors and authorities, when required to comply with law, respond to lawful requests, or protect our rights;
  • A successor business, if Chomper Labs is ever involved in a merger, acquisition, or sale of assets — in which case this policy would continue to protect your information.

We do not sell your personal information for money. As noted above, the use of advertising cookies may be considered "sharing" under California law, and you can opt out as described in Section 4. Your dental information is never sold or shared for advertising, full stop.

7. Email and text messages

We send marketing by email only, and only if you've opted in — every marketing email includes an unsubscribe link. We do not send marketing text messages. If we ever text you, it will only be about your order — things like shipping updates or fit-check reminders — and you can stop those anytime by replying STOP. Opting out of marketing doesn't affect order emails; we'll still let you know where your night guard is.

8. How we protect your information

Our Site and data are hosted on secure, industry-standard infrastructure protected by firewalls and encryption. Payment card data is handled in accordance with PCI-DSS standards. That said, no method of transmission or storage is 100% secure, so we can't guarantee absolute security — but we work hard to protect what you trust us with.

9. How long we keep information

We keep personal information for as long as we need it to serve you and meet our legal obligations: order and account records for as long as required for tax, accounting, and warranty purposes; dental information per the two-year rule in Section 5; and marketing preferences until you opt out or ask us to delete them.

10. Your rights and choices

No matter where you live, you can contact us to:

  • Access the personal information we hold about you;
  • Correct anything that's inaccurate;
  • Delete your personal information (subject to legal record-keeping requirements);
  • Opt out of marketing communications and the sharing of your data for advertising.

Email hello@chomperlabs.com and we'll verify your identity and respond within the timeframe required by your state's law (typically 45 days). We will never discriminate against you — in pricing, service, or anything else — for exercising your privacy rights. You may also designate an authorized agent to make a request on your behalf.

11. California residents

The California Consumer Privacy Act (CCPA/CPRA) gives California residents specific rights. In the last 12 months, we have collected these categories of personal information: identifiers (name, address, email, phone); commercial information (orders and purchases); health information (dental impressions, scans, photos, and dental history you provide); internet activity (cookies and usage data); and inferences (like quiz results used to recommend a product). We collect them from you directly and from your use of the Site, for the purposes in Section 3, and share them with the categories of providers in Section 6.

We do not sell personal information. We may "share" internet activity data with advertising partners as defined by the CPRA; you can opt out via the methods in Section 4 or by emailing hello@chomperlabs.com with the subject "Do Not Share." California residents also have the rights to know, delete, correct, and limit the use of sensitive personal information, exercisable as described in Section 10.

12. International visitors

Chomper Labs operates from the United States, and our products are made and sold for US customers. If you visit the Site from outside the US, your information will be processed and stored in the United States.

13. Children

Our products and Site are intended for adults 18 and over. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we'll delete it.

14. Changes to this policy

If we make changes, we'll post the updated policy here with a new effective date. For significant changes — especially anything affecting your dental information — we'll make reasonable efforts to notify you directly.
